Terms of Service

These Terms of Service (“Terms”) govern your use of chatacus’s AI website assistant products, including Vaughan, Bloom, Sunny Jim and Impeccable (each a “Ready-Made” assistant) and any bespoke assistant we build for you (together, the “Service”), provided by chatacus (“chatacus”, “we”, “us”). By purchasing, onboarding to, or embedding the Service on your website, you agree to these Terms.
1. The Service
chatacus provides an AI-powered chat assistant that you embed on your own website using a short script snippet we give you after onboarding. The assistant answers visitor questions, represents your business using the information you provide during onboarding, and passes on enquiries (“leads”) it captures to the contact details you give us.
Ready-Made assistants use a shared underlying template for their industry, personalised with the business details you supply. A bespoke assistant is built specifically around your business under a separate scope agreed with you.
2. Your account and subscription
The Service is billed as a recurring monthly subscription and processed by our payment provider, Stripe. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel. Prices are as shown at checkout; we’ll give you reasonable notice by email before any price change takes effect for your subscription.
You’re responsible for keeping your payment details up to date and for the accuracy of the information you give us during onboarding — the assistant represents your business using exactly what you tell it, so incomplete or inaccurate onboarding information may result in an assistant that gives incomplete or inaccurate answers to your visitors.
3. Cancellation
You can cancel your subscription at any time from your billing portal (a link is available in your confirmation email, or on request to marc@chatacus.co). Cancellation takes effect at the end of your current billing period; your assistant stays live until then, and is deactivated after. See our Refund & Cancellation Policy for details on refunds.
4. Acceptable use
You agree not to use the Service to:
- Represent your business dishonestly or provide false onboarding information intended to mislead your own visitors;
- Collect visitor data unlawfully, or in a way that breaches your own obligations to your visitors (including data protection law);
- Attempt to interfere with, disrupt, or reverse-engineer the Service or the underlying assistant infrastructure;
- Use the Service for any unlawful, harmful, or fraudulent purpose.
We may suspend or terminate the Service if we reasonably believe it’s being used in breach of these Terms, or if payment fails and isn’t resolved within a reasonable period.
5. AI-generated responses
The assistant uses artificial intelligence to generate its responses. While we design and test each assistant carefully, AI-generated responses can occasionally be incomplete, out of date, or incorrect. You’re responsible for reviewing the information your assistant is given during onboarding and for monitoring the leads and conversations it produces. The Service is not a substitute for professional advice, and neither the assistant nor chatacus should be relied upon as the sole source of information given to your visitors on matters of legal, financial, medical, or safety significance.
6. Leads and your data
Leads captured by your assistant belong to you. We process them only to deliver them to you (by email, and by any other channel you’ve enabled) and to operate the Service. See our Privacy Policy for full detail on what we collect and how it’s used.
7. Intellectual property
chatacus retains all rights in the underlying assistant software, prompt templates, and platform. You retain all rights in your own business name, branding, and content. Nothing in these Terms transfers ownership of either party’s intellectual property to the other.
8. Availability
We aim to keep the Service available at all times, but we don’t currently offer a guaranteed uptime commitment or service credits. We’ll make reasonable efforts to notify you of planned maintenance or known issues affecting your assistant.
9. Limitation of liability
To the fullest extent permitted by law, chatacus’s total liability to you arising out of or in connection with the Service is limited to the amount you’ve paid us in the 3 months before the claim arose. We’re not liable for indirect or consequential loss, including lost profits or lost business, arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by our negligence, or for fraud.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll notify you by email before they take effect. Continued use of the Service after that point means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
